By accessing, visiting, submitting any information to or otherwise using www.Hairloss.com, any of its webpages, subdomains, or features (collectively “Hairloss.com”) you are accepting the practices described in this Privacy Policy, as well as our Terms and Conditions of Use (the “Terms of Use”). For purposes of this Hairloss.com Privacy Policy, the terms “we”, “us” or “our” means AMM Industries, a Florida corporation, and any and all entities that control, are controlled by or are affiliated or under common control with AMM Industries.

  1. Collection of Personally Identifiable Information. The supplying of any information by you to us is voluntary on your part. You have the right to withdraw your consent in accordance with the terms of this Privacy Policy and the Terms and Conditions of Use, however, your withdrawal of consent will not be retroactive. If you have any hesitation about providing information to us or about having such information displayed on store.hairloss.com or otherwise used in any manner permitted in this Privacy Policy or in the Terms and Conditions of Use, you should not submit such information to us and should not use store.hairloss.com. Some features of store.hairloss.com require you to provide “personally identifiable information”. We may collect personally identifiable information from you if you choose to fill out any form, profile, or survey on store.hairloss.com. (e) Correspondence. If you send us personal correspondence, whether as emails, letters, or otherwise, or if other users or third parties send us correspondence about your activities or postings on store.hairloss.com, we may choose to collect such information about you. (f) Other Sources. We may receive and collect information about you from other sources, such as instant messaging services, blogs, newspapers, other users of our products and services, and our affiliates or business associates. store.hairloss.com is neither intended for nor designed to be used by anyone who is less than 18 years of age. You represent that you are at least 18 years of age. We do not collect personally identifiable information from anyone we actually know is a minor under the age of 13. If we receive a complaint which states that a user is under 13 years of age, we will comply with the requirements of the Children’s Online Privacy Protection Act of 1998 (“COPPA”)

  3. Disclosure of Personally Identifiable Information. The following describes some of the ways that your personally identifiable information may be disclosed: (a) Forums. Any information that you place or submit to be placed within any Forum, blog or chat room on store.hairloss.com may be disclosed to the public. (b) Advertisers. We may aggregate personally identifiable information and disclose that information in a non-personally identifiable manner to advertisers and other third parties for their marketing and promotional purposes. Personally identifiable information and other information collected from you may also be transferred to a third party as a result of a sale, acquisition, merger, other transfer, reorganization, or bankruptcy (a “Transfer”) involving us or our affiliates. We specifically reserve the right to transfer personally identifiable information (and any other information) collected from you, whether through store.hairloss.com or otherwise, or any of its databases, together with any personally identifiable or other information contained therein, to a third party in connection with a Transfer, and nothing in this Privacy Policy is intended to nor may be construed or operate so as to interfere with our ability to transfer all or part of our business or assets (including store.hairloss.com) to an affiliate or independent third party at any time, for any purpose, without any limitation whatsoever. Although we use security measures to keep your personally identifiable information anonymous, no security measure is perfect or impenetrable. We cannot ensure that all of your private communications on or through store.hairloss.com and other personally identifiable information will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example, but not limitation, we may be forced to disclose personally identifiable information to the government or to third parties under certain circumstances, or third parties may unlawfully intercept or access transmissions or private communications.   4. Changes to Personally Identifiable Information and User Preferences. You can review the personally identifiable information you have provided to us and make changes to that information, or to the settings for your store.hairloss.com account, including your email and contact preferences, by logging into your account on store.hairloss.com. Note however that even after your request for a change is processed we may for a time retain the prior residual information about you in back-up and/or archival copies of our database.   5. Network Advertising. We may use third-party advertising companies for marketing, advertising, and promotional purposes, and to serve advertisements to you. Using third-party advertising companies helps us, and third-party advertisers, better determine which advertisements or content to serve to you. For example, third party advertisers may use information regarding your visits to store.hairloss.com and other websites in order to provide advertisements about goods and services that third party advertisers believe will be of interest to you.   6. Emails and Newsletters. We may from time to time provide you with information or advertisements regarding a variety of topics, through the use of newsletters or other email communications. Your initial selection regarding the types of information, topics, newsletters, or other email communications you may be interested in receiving is made during the registration process, however, you can opt into or out of any of these email services by utilizing our Opt-in/ Opt-out procedure. If you choose to use store.hairloss.com to send someone information from our website (such as an email or newsletter) we will ask for that person’s email address and will send an email with the information requested by the sender. We do not use the recipient’s email address for anything other than the intended use. Nor do we store the recipient email address except in cases when the recipient requests that we include them in future store.hairloss.com communications. We may use the information we collect from you to provide you with newsletters, alerts, special offers, promotional offers or market research surveys by email, and we may maintain separate email lists for different purposes. Our opt-out or unsubscribe process impacts only the future delivery of electronic mailings disseminated by us on our own behalf. In certain commercial email messages sent by us, an Advertiser’s name will appear in the “From” line but hitting the “Reply:” button will cause a reply email to be sent to us. The “Subject:” line of our email messages will usually contain a line provided from the Advertiser to us. Solicited Email. We only send email to individuals who have agreed on store.hairloss.com to receive email from us or to persons who have agreed on a third party website to receive email from third parties. As such we do not send unsolicited email messages. Targeted Advertising. We may use the information we collect from you to target advertising to you and may attempt to show you advertising for products and services in which we believe you may have an interest-based upon the information we have collected from you. If the email address you provide to us is a wireless email address, you agree to receive messages at such address from us or our business associates (unless and until you have elected not to receive such messages by following the instructions in the unsubscribe portion of this Privacy Policy). You understand that your wireless carrier’s standard rates apply to these messages. Short Message Service. We may make available a service through which you may receive messages on your wireless device via short message service (“SMS Service”). Data obtained from you in connection with such SMS Service may include your name, address, cell phone number, your provider’s name, and the data, time, and content of your messages. You represent that you are 18 years of age and the owner or authorized user of the wireless device on which messages will be received and that you are authorized to approve the applicable charges. In addition to any fee of which you are notified, your provider’s standard message rates apply to our confirmation and all subsequent SMS correspondence. All charges are billed by and payable to your mobile service provider. We will not be liable for any delays in the receipt of any SMS messages, and delivery is subject to effective transmission from your network operator. SMS Message Services are provided on an AS-IS basis. We may also obtain the date, time, and content of your messages in the course of your use of the SMS Service. We will use the information we obtain in connection with our SMS Service (if any) in accordance with this Privacy Policy. If fees are charged to your wireless account invoice, we may provide your carrier with your applicable information in connection therewith. Your wireless carrier and other service providers may also collect data about your wireless device usage, and their practices are governed by their own policies. You acknowledge that the SMS Services provided via wireless systems that use radios (and other means) to transmit communications over complex networks. We do not guarantee that your use of the SMS Service will be private or secure, and we are not liable to you for any lack of privacy or security you may experience. You are fully responsible for taking precautions and providing security measures best suited for your situation and intended use of the SMS Service. We may also access the content of your account and wireless account with your carrier for the purpose of identifying and resolving technical problems and service-related complaints. You may remove your information from our database. If you remove your information from our database it will no longer be used by us for secondary purposes, disclosing to third parties or used by us to send promotional correspondence to you.   7. Can-Spam Compliance. We send only verified, double opt-in emails, specifically requested by our subscribers. We are compliant with the Controlling the Assault of Non-Solicited Pornography and Marketing of Act of 2003.
  8. Our Use of Cookies and Web Beacons. Like most websites, store.hairloss.com uses Cookies and web log files to track site usage. “Cookies” are alphanumeric identifiers in the form of text files that are inserted and stored by your web browser on your computer’s hard drive. We, our external service providers, internal service providers, and third-party advertising companies, may set and may access Cookies on your computer in order to track and store preferential information about you.   12. Changes to This Privacy Policy. We reserve the right at all times to update, amend, or change this Privacy Policy or any part thereof at any time in our sole and absolute discretion and without notice. Updates to this Privacy Policy will be posted here. Information we collect from you online is subject only to our most current Privacy Policy. You are encouraged to revisit this Privacy Policy from time to time in order to review any changes that have been made. Our last update was 11/5/09.   13. Governing Law; Arbitration. This Privacy Policy shall be governed by and construed in accordance with the internal laws of the state of Florida without regard for principles of conflicts of laws. Any civil action, claim, dispute, or proceeding arising out of, or relating to, this Privacy Policy shall be referred to final and binding arbitration before a single arbitrator under the Commercial Arbitration Rules of the American Arbitration Association in Broward County, Florida. You and we shall select the arbitrator and if you and we are unable to reach agreement on selection of the arbitrator within 30 days after the notice of arbitration is served, then the American Arbitration Association shall select the arbitrator. The arbitration shall not commence until the party requesting it has deposited $1,000.00 with the arbitrator as a retainer for the arbitrator’s fees and costs. The party requesting arbitration shall advance such sums as are required from time to time by the arbitrator to pay the arbitrator’s fees and costs until the prevailing party is determined or the parties have agreed in writing to an alternate allocation of fees and costs. Judgment upon any award rendered by the arbitrator shall be final, binding, and conclusive upon you and us and your and our respective administrators, executors, legal representatives, successors and assigns, and may be entered in any court of competent jurisdiction. Notwithstanding the immediately preceding sentence, in no event shall either you or we be entitled to punitive, special, indirect, or consequential damages, and both you and we hereby waive respective rights to any punitive, special, indirect, or consequential damages, including but not limited to, damages from a loss of profit, revenue, or business. PERSONAL INFORMATION WE COLLECT

Information Collection

We collect information from you in several different ways on this site. One goal in collecting personal information from you is to provide an efficient, meaningful, and customized experience. For example, we can use your personal information to:

  • help make the Site easier for you to use by not having to enter information more than once.
  • help you quickly find information, products, and services.
  • help us create content that is most relevant to you.
  • alert you to new information and products, promotions and services that we offer.

a) Registration and Ordering. Before using certain parts of any Site or ordering products, you must complete an online registration form. During registration, you will be prompted to provide to us certain personal information, including but not limited to your name, shipping and billing address(es), phone number, email address, and credit card number. In addition, we may also ask you for your country of residence and/or your organization’s country of operation, so we can comply with applicable laws and regulations. (b) Email Addresses. Several locations of the Site permit you to enter your email address for purposes including but not limited to: registering for a contest or sweepstakes; to request alerts that will notify you of new brands, new product styles, or other new products; or to sign up for email newsletters and special offers. Your participation in a contest or sweepstakes is completely voluntary, so you have a choice whether to participate and disclose information to us. We use this information to notify contest and sweepstakes winners and to award prizes. We may post on the Site the names, cities and states, photos and/or videos of contest and sweepstakes winners. (c) Phone Numbers for Order Notifications and Text Marketing (if applicable): By entering your phone number in the checkout and initializing a purchase, you agree that we may send you text notifications (for your order, including abandoned cart reminders) and text marketing offers. Text marketing messages will not exceed 2 per month. You can unsubscribe from further text messages by replying STOP. Message and data rates may apply.

(d) Cookies and Other Technology. Like many sites, the Site employs cookies and web beacons (also known as clear GIF technology or “action tags”) to speed your navigation of the Site, recognize you and your access privileges, and track your Site usage.

(f) Age. The Site is a general audience site. Protecting children’s privacy is important to us. By using the Site you represent and warrant that you are either 18 years of age or older, or using the Site with the supervision of a parent or guardian. If you are under the age of 13, please do not submit any personal information to us, and rely on a parent or guardian to assist you. We do not knowingly or intentionally collect personal information from children under age 13.

(g) Product Reviews. You may choose to submit a product review. If you post a review, we will ask for your email address and geographic location. If you submit a review, your geographic location will be visible to other users (your email address will be kept private). Also, any personally identifiable information that you submit as part of the review can be read or used by other visitors to the Site. We are not responsible for any personally identifiable information that you choose to submit as part of your review. Also, you may submit your email address for reasons such as to register for a contest or sweepstakes; to request us to notify you of new brands, new product styles, or product sizes; or to sign up for email newsletters and special offers. If you submit your email address, we use it to deliver the information to you. We always permit you to unsubscribe or opt-out of future emails (see the opt-out section, below, for more details). Because we have to communicate with you about orders that you choose to place, you cannot opt-out of receiving emails related to your orders.

(c) External Use. We want to provide you with excellent service and to offer you a great selection. We do not sell, rent, trade, license or otherwise disclose your specific personal information or financial information to anyone other than to affiliates under Beauty and Hair’s control, except that:

(i) As do most catalog and Internet retailers, we sometimes use others to perform specific functions on our behalf. When we disclose information to these service providers, we disclose information to help them to perform their service. For example, in order to deliver products to you, we must share some information. We partner with third parties (such as United Parcel Service and the United States Postal Service) to ship products, to ensure delivery, and so that we can obtain feedback, improve the quality of our service, and measure and improve the quality of the service of the third party. In the example of shippers, we provide them some personally identifiable information such as your name, shipping address, email, and phone number.

(ii) Similarly, to help you buy products and provide customer service to you, we must provide your credit card number to financial-services corporations such as credit-card processors and issuers. When we submit your credit card number for authorization, we use state-of-the-art data encryption to protect your information. (More on this below in Data Security.)

(iv) We may disclose such information in response to requests from law enforcement officials conducting investigations; subpoenas; a court order; or if we are otherwise required to disclose such information by law. We also will release personal information where disclosure is necessary to protect our legal rights, enforce our Terms of Use or other agreements, or to protect ourselves or others. For example, we may share information to reduce the risk of fraud or if someone uses or attempts to use the Site for illegal reasons or to commit fraud.

(v) We will not sell (or trade or rent) personally identifiable information to other companies as part of our regular course of business. Please do not email your credit-card number or other sensitive information. Offline Collection, Use & Disclosure of Information

As you might expect from us, the majority of information that we collect is obtained through the Site, and this Privacy Policy applies only to that online collection of personal information. We also may collect information offline, where we also try to protect the privacy of your personal information. One example involves someone calling us to place an order or to ask questions. When someone calls, we will ask only for the personal information we need in order to place the order or to answer the question. When we need to store information (such as order information), we will enter it into our database through SSL encryption. (See the Data Security section above for more information). Another example involves faxes. If you fax something to us, we will act upon the fax and then either store it a locked repository or we will shred the fax if there is no need to retain the information.
